Terms of Service

By using the Lady Bird Deed Now website, applications (if any), and services provided by Lady Bird Deed Now LLC (“Lady Bird Deed Now,” “we,” “us,” or “our”), I acknowledge and agree to the following Terms of Service (“Terms”).
1. Not a Law Firm. I understand and agree that Lady Bird Deed Now is not a law firm or an attorney. I understand that Lady Bird Deed Now does not provide legal advice, guidance, or representation, and does not engage in the practice of law. I further understand that the platform is a self-service tool, and that no attorney–client relationship or privilege is created by my use of these services.
2. No Legal Advice. I understand and agree that if, before or during my purchase, I believe Lady Bird Deed Now has given me legal advice, opinions, or recommendations about my rights, remedies, or strategies, I will not proceed with my order. If I proceed with my order, I acknowledge that I am doing so voluntarily and without reliance on any alleged legal advice.
3. Private Entity / Government Disclaimer. I understand and agree that Lady Bird Deed Now is a private company, not a law firm, and is not affiliated with, endorsed by, or associated with the State of Florida or any government agency. I further understand and agree that this same disclaimer applies in any other state where services are offered.
4. Use of Website / Acceptable Use.
(a) Eligibility. I understand and agree that by using the site, any applications, and the services, I am at least 18 years of age and legally able to enter into a contract. I understand that the site is made available for my personal use on my own behalf, and that minors are not eligible to use the site or services. I understand that Lady Bird Deed Now does not knowingly collect personal information from individuals under 18, and if such information is discovered, it will be promptly deleted.
(b) Account Security. I understand and agree that if I create an account, I will provide accurate information, keep my login credentials confidential, and promptly notify Lady Bird Deed Now of any unauthorized use. I understand and agree that I am responsible for all activity under my account. If I believe my account or system security has been compromised, I will immediately contact Lady Bird Deed Now at legal@ladybirddeednow.com
(c) Acceptable Use. I understand and agree that I will not misuse the site or services, including by:
- Uploading false, inaccurate, or misleading content.
- Infringing any third party’s copyright, trademark, privacy, publicity, or other rights.
- Violating laws, including those related to consumer protection, unfair competition, or advertising.
- Posting or transmitting defamatory, obscene, threatening, harassing, hateful, or otherwise unlawful content.
- Uploading or transmitting malware, bots, or automated scraping/crawling tools.
- Using the site to send spam, marketing solicitations, or unauthorized communications (including using the contact form for marketing).
- Attempting to hack, probe, bypass, or disrupt the site’s operation or security.
- Failing to follow any formatting or technical guidelines posted on the site.
(d) Content I Provide. I understand and agree that I am legally and ethically responsible for the content I post or submit. I understand and agree that I retain copyright in my original works, but I grant Lady Bird Deed Now a limited license to use my submissions solely as needed to provide the services (including generating deeds, customer support, quality control, and required recordkeeping). I understand and agree that Lady Bird Deed Now may edit, remove, or re-categorize submitted content if it violates these Terms. I understand and agree that reviews or feedback I provide may be used by Lady Bird Deed Now consistent with the Privacy Policy. By providing my phone or email, I agree to receive service-related communications as described in Sections 9–11.
(e) Intellectual Property. I understand and agree that the website, software, forms, and content are owned by Lady Bird Deed Now or its licensors and are protected by intellectual property laws. I will not copy, resell, redistribute, reverse engineer, or make derivative works from the site or its content, except to the extent allowed by these Terms and my purchase. I understand and agree that any permitted downloads are for my personal use (or my own internal business use) and must retain all notices.
(f) System Integrity & Enforcement. I understand that although Lady Bird Deed Now takes reasonable steps to maintain security, no system is guaranteed secure. If my activity or files threaten the site’s operation or other users’ security, I understand and agree that Lady Bird Deed Now may suspend or terminate my access, with notice provided as feasible. If I believe my account or system security has been compromised, I will immediately contact Lady Bird Deed Now at legal@ladybirddeednow.com
(g) Export & Restricted Use. I understand and agree that I will not use the site or services in violation of U.S. export laws, sanctions, or restrictions.
(h) DMCA / Copyright Complaints. I understand that Lady Bird Deed Now respects intellectual property rights. If I believe content on the site infringes my copyright, I will send a notice to legal@ladybirddeednow.com that complies with 17 U.S.C. § 512(c)(3), including:
- My signature (physical or electronic);
- Identification of the copyrighted work(s);
- Identification of infringing material and its location;
- My contact information;
- A good faith statement that use is unauthorized;
- A statement under penalty of perjury that my notice is accurate and I am authorized to act.
I understand that Lady Bird Deed Now may remove or disable access to infringing content upon receipt of a valid notice. If my content is removed, I understand that I may provide a counter-notice under 17 U.S.C. § 512(g).

(i) Unsolicited Submissions. I understand and agree that, except as required to use the services, Lady Bird Deed Now does not want confidential or proprietary information submitted through the site. I understand and agree that any comments, feedback, ideas, or materials I submit will be treated as non-confidential. By submitting them, I grant Lady Bird Deed Now a worldwide, royalty-free, irrevocable license to use, adapt, or share them without restriction. I understand and agree that I remain responsible for ensuring my submissions are lawful and appropriate.
5. My Responsibility for Accuracy. I understand and agree that I am solely responsible for the accuracy of all information I provide, including names, addresses, and legal property descriptions. I understand and agree that I will review and approve the final document before signing or recording it. I further understand and agree that Lady Bird Deed Now will not be liable for errors, omissions, or consequences that result from inaccurate, incomplete, or insufficient information I provide.
6. State-Specific Rules. I understand and agree that Lady Bird (Enhanced Life Estate) deeds are available only in certain states.
(a) Florida. Lady Bird Deed Now may cross-check my submission for obvious clerical issues (for example, spelling or parcel numbers). This is not legal review.
(b) Other supported states. My deed is generated automatically from the information I provide. Lady Bird Deed Now does not review or edit my input in those states.
(c) State Law Changes. I understand and agree that state and county laws, recording requirements, fees, and transfer form requirements may change at any time. Lady Bird Deed Now does not guarantee that information, form names, or procedural descriptions remain current after document delivery. It is my responsibility to confirm current recording requirements with the appropriate local authority prior to filing.
7. Recording and Notarization. I understand deeds must be properly signed, witnessed (if required), notarized, and recorded with the correct county office. Local offices may have different rules or fees. Lady Bird Deed Now does not guarantee that a recorder, lender, or title company will accept my deed.
(a) Deed Selection and Personal Responsibility. I understand and agree that Lady Bird Deed Now provides self-help tools that allow me to generate certain deed types, including Lady Bird Deeds (Enhanced Life Estate Deeds), Transfer on Death Deeds, and Beneficiary Deeds where permitted by state law. I understand and agree that deed availability depends on state law and that not all deed types are offered in every state. I understand and agree that I am solely responsible for choosing the type of deed I wish to create. If my state provides more than one deed option, I understand that Lady Bird Deed Now does not select a deed type for me, does not recommend one deed over another, and does not determine which deed is appropriate for my situation. Any descriptions of Lady Bird Deeds, Transfer on Death Deeds, Beneficiary Deeds, or any other document types are provided as general educational information only and are not legal advice. I understand and agree that Lady Bird Deed Now does not evaluate my circumstances, does not compare deed types for my situation, and does not advise me which deed meets my needs. If I require advice about which deed to use, I agree to consult a licensed attorney before proceeding. I understand and agree that any deed I generate is created automatically based solely on the information I enter and that Lady Bird Deed Now does not review, modify, interpret, or verify my selections.
(b) Pre-Death Recording Requirement. I understand and agree that, in most states, a deed must be properly signed, notarized, and recorded with the appropriate county recording office prior to the homeowner’s death in order to be effective as intended. I understand and agree that if a deed is not recorded prior to the homeowner’s death, it may be ineffective, invalid, or subject to probate depending on applicable state law. If the homeowner passes away during the transaction process, I understand and agree that no refund will be issued, as substantial services will have already been rendered.
(c) Affidavits and Post-Death Filings. I understand and agree that the completion, filing, and recording of any Affidavit of Heirship, Affidavit of Transfer, Affidavit of Death, or similar post-death documentation is the sole responsibility of the grantor, beneficiaries, or their representatives. Lady Bird Deed Now does not prepare, file, record, or monitor such affidavits unless expressly stated in writing as part of a purchased service.
(d) Transfer Tax and Exemption Forms. I understand and agree that I am solely responsible for completing, filing, and recording any required state or county transfer tax forms, exemption forms, declarations of value, property transfer statements, or similar documentation required by the recording jurisdiction. Failure to properly complete and file required forms may result in rejection of the deed, recording delays, penalties, or additional fees. Lady Bird Deed Now is not responsible for such outcomes.
(e) No Monitoring or Ongoing Obligations. I understand and agree that Lady Bird Deed Now does not monitor property status, homeowner status, recording status, tax status, or compliance after document delivery unless expressly included in a separately purchased service. I understand that it is my sole responsibility to ensure the deed is properly executed, notarized, witnessed (if required), recorded, and maintained in accordance with state and county requirements. Lady Bird Deed Now has no continuing duty to update, revise, re-record, or re-file any document after delivery.
(f) No Estate Planning Evaluation. I understand and agree that Lady Bird Deed Now does not evaluate my overall estate plan, tax consequences, Medicaid eligibility, creditor exposure, marital property implications, or potential title issues. I understand that a deed transfer may have legal, tax, lending, or benefit eligibility consequences. If I require advice regarding these matters, I agree to consult a licensed attorney or tax professional.
8. Third-Party Services. I understand Lady Bird Deed Now may connect me with independent third-party services (such as notaries or e-signature services). These providers are separate from Lady Bird Deed Now. Lady Bird Deed Now is not responsible for third-party services, content, pricing, policies, actions, or omissions. I use such services at my own discretion and risk.
9. Refunds and Abandoned Orders.
(a) All Sales Final. I understand and agree that once an order is submitted and processing begins, I have no right to cancel, refund, or receive credit, except where required by applicable law or in the event of a documented material error solely attributable to Lady Bird Deed Now.
Because services include document generation, automated system processing, administrative handling, compliance review (where applicable), and preparation for notarization and/or recording, substantial work begins immediately upon submission.
Dissatisfaction with recording outcomes, tax consequences, lender requirements, beneficiary disputes, state law interpretations, county rejections, or changes in personal circumstances does not constitute grounds for a refund.
(b) Abandoned Orders. If the required information is not provided within 30 days, services rendered up to that point will be considered complete, and your deed will be emailed to you in draft format (not reviewed or recorded).
(c) Reactivating an Order. If you wish to finalize and electronically file your deed after the 30-day window, a $100 continuation fee will apply to reopen and complete your order.
(d) Death During Transaction. If the homeowner passes away at any time after order submission, no refund will be issued, as services will have already been rendered.
(e) Chargebacks and Payment Disputes. I agree not to initiate a chargeback or payment dispute for services that have been submitted for processing or delivered, except in the event of an unauthorized transaction or as otherwise required by applicable law. If I believe there is an issue with my order, I agree to contact Lady Bird Deed Now first and provide a reasonable opportunity to investigate and attempt to resolve the issue before initiating any chargeback or payment dispute.
I understand that initiating an improper chargeback may delay services, may result in account suspension, and may require me to reimburse Lady Bird Deed Now for associated chargeback fees, processing costs, and reasonable administrative expenses to the fullest extent permitted by law.
10. Privacy. I understand my use of the services is also governed by the Privacy Policy, which explains how my data is collected, used, and protected.
11. SMS and Electronic Communications. I understand that by providing my phone number or email, I consent to receive electronic communications (including SMS and email) related to my order, updates, reminders, and services. Message frequency varies. Standard message and data rates may apply. I may opt out of SMS at any time by replying “STOP.”
We do not sell or share mobile phone numbers collected for SMS communications.
12. Electronic Records and Signatures. I understand that electronic records and signatures may be used where permitted by law.
13. Disclaimer of Warranties. I understand all services and materials are provided “AS IS” and “AS AVAILABLE.” Lady Bird Deed Now makes no warranties of any kind, including fitness for a particular purpose. I understand Lady Bird Deed Now does not guarantee:
(a) that documents will meet my specific legal or tax needs;
(b) that the website or services will operate uninterrupted, securely, or error-free; or
(c) that information provided is complete, up to date, or accurate. I obtain services at my own discretion and risk.
14. Limitation of Liability. I understand that, to the fullest extent allowed by law:
(a) Lady Bird Deed Now is not liable for any indirect, incidental, special, or consequential damages; and
(b) If liability is found for any reason, the total cumulative liability of Lady Bird Deed Now shall not exceed the total amount paid by me for the specific transaction giving rise to the claim, regardless of the form of action or theory of liability.
The limitations set forth in this Section apply even if any limited remedy fails of its essential purpose.
15. Indemnification. I agree to defend and hold harmless Lady Bird Deed Now, its officers, directors, employees, and agents from any claims, damages, or costs arising from my use of the services or from inaccurate or incomplete information I provide.
16. Dispute Resolution and Arbitration.
(a) Individual Arbitration Only. I understand disputes will be resolved by binding arbitration on an individual basis, not in court and not through class actions.
(b) Small Claims Exception. Either party may bring an individual claim in small claims court in Palm Beach County, Florida, or my U.S. county of residence (if allowed).
(c) Rules & Forum. I understand arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
(d) Informal Resolution First. Before filing for arbitration, either party will send a written notice of the dispute and allow 30 days to try to resolve it informally.
(e) Location & Conduct. Unless agreed otherwise, arbitration will be held in Palm Beach County, Florida, or conducted remotely where available.
(f) Federal Arbitration Act. I understand these Terms involve interstate commerce; the FAA governs enforceability of this Section.
(g) NO CLASS ACTIONS. I UNDERSTAND AND AGREE THAT I WAIVE ANY RIGHT TO PARTICIPATE IN CLASS OR REPRESENTATIVE ACTIONS OR ARBITRATIONS.
(g-1) CLASS ACTION WAIVER REINFORCEMENT. I UNDERSTAND AND AGREE THAT ANY CLAIMS AGAINST LADY BIRD DEED NOW MAY BE BROUGHT ONLY IN MY INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, REPRESENTATIVE, OR PRIVATE ATTORNEY GENERAL PROCEEDING.
(h) Confidentiality. To the extent permitted by law, arbitration proceedings and any award will be confidential.
(i) OPT-OUT. I UNDERSTAND AND AGREE that I may opt out of arbitration within 30 days of my first acceptance of these Terms by sending a written notice to: Lady Bird Deed Now LLC, Arbitration Opt-Out, 433 Plaza Real Suite 275, Boca Raton, FL 33432.
(j) Severability (Arbitration). If any part of this Section 16 is unenforceable, the remainder still applies; if a claim must proceed on a class basis, it must be litigated in court, not arbitrated.
(k) Survival. This arbitration provision survives termination of services and remains enforceable after the completion of any transaction.
(l) Batch Arbitration Prevention. To the extent permitted by law, claims by multiple customers may not be consolidated or coordinated in a single arbitration proceeding without the express written consent of Lady Bird Deed Now.
(m) Time Limitation on Claims. I agree that any claim arising out of or relating to the services must be filed within one (1) year after the event giving rise to the claim, or it will be permanently barred, to the fullest extent permitted by law.
17. JURY TRIAL WAIVER. TO THE FULLEST EXTENT PERMITTED BY LAW, I AND LADY BIRD DEED NOW EACH KNOWINGLY AND VOLUNTARILY WAIVE ANY RIGHT TO A TRIAL BY JURY IN ANY ACTION OR PROCEEDING ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES, TO THE EXTENT SUCH DISPUTE IS NOT SUBJECT TO ARBITRATION. THIS WAIVER IS A MATERIAL PART OF THESE TERMS.
18. Governing Law and Venue. I understand these Terms are governed by the laws of the State of Florida. For disputes not subject to arbitration or small claims court, the exclusive venue is in the state or federal courts of Palm Beach County, Florida.
19. CALIFORNIA RESIDENTS. If I am a California resident, I understand that I may have additional rights under California law, and nothing in these Terms is intended to waive any non-waivable rights or remedies available to California consumers. The arbitration, class action waiver, and jury trial waiver provisions will be enforced to the maximum extent permitted by applicable law.
20. Termination/Suspension. I understand Lady Bird Deed Now may suspend or terminate my access to services if I violate these Terms, applicable law, or misuse the platform (including suspected fraud, abuse, or security risks).
21. Force Majeure. I understand Lady Bird Deed Now is not responsible for delays or failures caused by events beyond its control, including but not limited to acts of God, natural disasters, internet or power outages, strikes, labor issues, governmental actions, changes in law, or other unforeseeable events.
22. Changes to Terms. I understand Lady Bird Deed Now may update or revise these Terms at any time. Continued use of the services after changes are posted means I accept the revised Terms.
23. Severability and Waiver. I understand that if any part of these Terms is invalid or unenforceable, the rest remains in full force and effect. Lady Bird Deed Now’s decision not to enforce any right or provision does not waive that right or provision.
24. Legal and Tax Disclaimer. I understand Lady Bird Deed Now does not provide legal, tax, or estate planning advice, and nothing provided creates an attorney–client relationship. Any documents or information provided are for informational purposes only and are not a substitute for professional legal or tax advice.

26. Entire Agreement.
(a) No Reliance. I acknowledge and agree that I have not relied on or been induced by any oral statements, sales conversations, marketing materials, advertisements, testimonials, or representations outside these Terms (and the Privacy Policy and any posted policies referenced herein) in deciding to purchase or use the services.
(b) Entire Agreement. I understand these Terms, together with the Privacy Policy and any posted policies, form the entire agreement between me and Lady Bird Deed Now.
27. Acceptance. By purchasing or using Lady Bird Deed Now’s services, I confirm that I have read, understand, and accept these Terms of Service.
